This privacy notice explains how we uses your personal information collected from you through the App Service.

If applicable jurisdiction requires us a legal basis for processing of personal information, our legal basis is explicit consent made prior to the use of mobile application by clicking box of terms and use and privacy notice.

We may make your information available to our subsidiaries, affiliates, and dealer or boat builder, and contractors within the scope necessary to achieve the purpose of use. As a global head quarter of Yamaha Motor group is located in Japan, your data will also be transferred to Japan. Upon transferring your data, we will take appropriate measures in accordance with provisions set forth in applicable laws and regulations. 
Regardless of the purpose of use, your data may be converted into a form whereby an individual is unable to be identified and then shared with the third parties as statistical or aggregated data.

 We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including as described in this Privacy Notice, or as required by laws and regulations. 

6. Your Privacy Rights 

We respect your privacy rights. Regardless of where you reside, you are entitled to following rights.

GPS service is essential to our service. If you wish to opt out of processing of your GPS locational information, please request us to opt out from our service.

You have a right to opt out of disclosure of your personal information in change for monetary consideration.

H) The right to opt out of targeted advertising 
You have a right to opt out of disclosure of your personal information to the third party for targeted advertising.

In those case, certain personal information may be exempt from such requests under applicable law. Cross-context behavioral advertising” means the targeting of advertising to a consumer based on the consumer’s personal information obtained from the consumer’s activity across businesses, distinctly-branded websites, applications, or services, other than the business, distinctly-branded website, application, or service with which the consumer intentionally interacts.

Yamaha Motor Group Online Service Privacy Policy 

This online service privacy policy (hereinafter referred to as “this Privacy Policy”) applies to users (hereinafter referred to as “you” or “your”) using this application software or online services on the website (hereinafter collectively referred to as “Applications”) using the Yamaha Motor ID provided by Yamaha Motor Co., Ltd., its subsidiaries and affiliates (hereinafter referred to as “we”, “us” or “our”). 

For the Applications, in addition to this Privacy Policy or separately from this Privacy Policy, there might be a separate Application Privacy Policy (hereinafter referred to as “Application Policy”) that informs you of detailed information related to the processing of customer data. If there is a conflict between this Privacy Policy and the Application Policy for such services, the Application Policy will take precedence. 

 

Information We Collect About You 

We collect and use data related to customers who use the Applications (hereinafter referred to as “your data”) after notifying of Application Policy in advance. Your data may include your personal data.

We may share your data with Yamaha Motor Co., Ltd. and its subsidiaries, affiliates and counterparties (such as distributors and dealers) in the country or region where you live in necessary to achieve the purpose of use.

2) Provision to contractors 
When providing the Applications, we may entrust in whole or in part of its business and provide your data to the contractors within the scope necessary to achieve the purpose of use. When entrusting the processing of your personal data to the contractors, we will take necessary and appropriate measures in accordance with applicable laws and regulations. 
3) International data transfer 
We are engaged in business activities on a global scale, and in some cases we will transfer your personal data to a country or a region that does not have laws and regulations equivalent to those related to protection of personal data in the country or the region where you reside / locate. Upon transferring your personal data abroad, we will take appropriate measures in accordance with applicable laws and regulations.

In principle, the provision of your personal data to us is made based on your will, and you are not obligated to provide us with your personal data. 

However, if you do not provide us with your data, you may experience disadvantages, such as inability to use the Applications or partial system malfunctions. 

 

3) Logging in from social media accounts 

Some Applications adopt functions that enable you to log in by using their social media (including Facebook and Google) accounts. When you use those functions, we may request your permission to use your social media account information, which includes name and email address, and you will be able to utilize the Applications using those functions if you grant that permission. You may at any time remove your account from the Applications and withdraw your approval from your social media accounts. 

Please note that if you use a social media account to log in to the Applications, it is possible that the social media provider will process information related to you, such as use of the Applications, and we will not be liable for that processing of your information. For details on information related to you that is processed by each social media provider, please refer to each social media provider’s privacy policy. 

 

4) Processing of children’s personal data 

When we obtain a child’s personal data, if required, we will obtain consent from statutory agents, such as a person with parental authority over that child. We will also take other steps, if required, in accordance with applicable laws and regulations.

The Applications may generate cookies, web beacons and other similar technologies. These enable us to provide you with an enhanced experience when you use the Applications and allow us to improve the Applications. Please see the cookie policy for details.

We have established a management structure for protecting personal data to prevent unauthorized access to your data, loss, destruction, falsification, leakage, etc. We take appropriate organizational, physical and technical safety measures as follows:

Implement measures to prevent unauthorized access from outside (installation of firewalls, etc.). 
Access to the system is constantly monitored and access logs are saved. 

 

We recognize the importance of protecting personal data and take appropriate measures for employees who process personal data such as giving for training/education to protect personal data. 

If any accident such as leakage of personal data occurs, we will appropriately respond to it by investigating all facts and the cause and taking measures to prevent secondary damage and reoccurrence, etc.

If you exercise rights (right of access, right to erasure, and the like) as permitted within the relevant jurisdiction, we will faithfully and appropriately deal with that exercise of rights in accordance with provisions set forth in applicable laws and regulations. If you wish to access, correct, delete or the like your data, please contact us through the Applications. 

Please note that some or all of your data is necessary to fulfill the obligations of applicable laws and regulation and/or provide the Applications functions properly, and some of your data may be retained. 

We store your data for the period necessary to achieve the purpose of use, or the period necessary to fulfill the obligations of applicable laws and regulations.
